These Terms of Service (“Terms”) govern your access to and use of services provided by SKG and LERACH SKG BOCAZZILA INC. (together, “SKG”, “we”, “us”, or “our”), including our websites, online booking tools, and any in-person services (the “Services”).

By booking a service, creating a booking request, using our websites, or otherwise interacting with SKG, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. Who We Are and Scope of These Terms

These Terms apply to Services provided in Canada by:

  • SKG (including its divisions and brands); and

  • LERACH SKG BOCAZZILA INC.

collectively referred to as “SKG”.

1.2 Territorial scope
These Terms apply to Services rendered in Ontario and elsewhere in Canada, subject to applicable federal and provincial consumer-protection and privacy laws.

1.3 Relationship with Privacy Policy
Your use of our Services is also governed by our Privacy Policy, which describes how we collect, use, and disclose personal information in Canada. If there is a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy prevails for those specific issues.

2. Eligibility and Client Representations

2.1 Eligibility
By using our Services, you represent that you:

  • Are at least the age of majority in your province or territory of residence;

  • Have legal capacity to enter into binding contracts; and

  • Are acting either on your own behalf or as an authorized representative of a business, property owner, or lawful occupant.

2.2 Accuracy of information
You agree that all information you provide to SKG (including contact details, service address, access instructions, and payment details) is accurate, current, and complete. You must promptly update us if any information changes before the date of service.

3. Description of Services

3.1 Scope of Services
SKG provides, among other things:

  • Residential cleaning and organizing;

  • Office and commercial cleaning;

  • Short-term rental / hospitality-oriented services (including Airbnb and similar);

  • Closet, basement, and storage organization;

  • Post-construction and deep cleaning;

  • Other related or specialized services as described on our website, quote, or booking confirmation.

3.2 Service details and limitations
The exact scope of work for any visit is defined by the applicable:

  • Service category selected;

  • Add-ons or options chosen; and

  • Written notes, quote, or booking confirmation issued by SKG.

We may decline to perform certain tasks that, in our reasonable judgment, are unsafe, unlawful, structurally unsound, or beyond the scope of our tools, training, or insurance.

3.3 No guarantee of outcomes beyond reasonable efforts
Our commitment is to perform Services with reasonable care, skill, and diligence. We do not guarantee a particular aesthetic result where limitations are caused by pre-existing damage, wear, structural conditions, poor materials, or other factors outside our control.

4. Bookings, Changes, and Cancellations

4.1 Booking requests
You may request a booking through our website, phone, email, or any other channel we make available. A booking request does not become confirmed until:

  • SKG accepts the request; and

  • You receive a booking confirmation (via email, text, or other written channel).

4.2 Rescheduling and cancellations by client
You may request to reschedule or cancel a booking by contacting us through our designated channels. SKG may, in its discretion, apply cut-off times and fees (for example, if cancellation or rescheduling occurs within a defined time window before the scheduled visit). Any such policy will be communicated on our website, booking page, or at the time of confirmation.

4.3 Cancellations or changes by SKG
SKG may, on reasonable notice (or urgently, where necessary), reschedule or cancel a booking due to:

  • Weather conditions, safety concerns, or access issues;

  • Illness or emergency affecting staff;

  • Operational issues or circumstances beyond our reasonable control.

Where practicable, we will offer to reschedule. SKG is not liable for indirect or consequential losses arising solely from rescheduling or cancellation, subject always to applicable consumer-protection laws.

4.4 No access / lock-outs
If our staff arrive at the service location at the confirmed time and cannot gain access (for example, due to missing keys, incorrect codes, or no one present where required), SKG may:

  • Treat the visit as a completed booking for billing purposes; or

  • Charge a reasonable call-out or cancellation fee, consistent with any written policy communicated to you.

5. Client Responsibilities – Access, Environment, and Safety

5.1 Safe and reasonable access
You must ensure SKG has safe and lawful access to the property, including:

  • Updated buzzer codes, keys, or entry instructions;

  • Information about alarms, pets, or building rules;

  • A safe path to the areas to be serviced.

5.2 Preparation of space
You agree to:

  • Remove or secure fragile, irreplaceable, or extremely valuable items if you do not want them touched;

  • Disclose any known hazards (e.g., broken glass, structural damage, mold, pests, or biohazards) before the visit;

  • Inform SKG of any surfaces or materials requiring special care.

5.3 Pets and occupants
You must ensure that pets and occupants do not create unsafe conditions for our staff (e.g., aggressive animals, unsafe behavior, or obstruction of work areas). SKG may refuse or suspend work if staff feel unsafe or if conditions are materially different from what was described at booking.

5.4 Health and safety
SKG reserves the right to decline or discontinue Services where:

  • Conditions pose a meaningful health, safety, or contamination risk; or

  • The environment reasonably appears to be in violation of building codes, public health rules, or other legal requirements.

6. Fees, Payment, and Taxes

6.1 Fees and estimates
Service fees will be communicated via:

  • Online booking interface;

  • Written quote; or

  • Confirmation message.

Quotes may be estimates where the condition or size of the property cannot be fully verified in advance. If the actual work required is substantially greater than estimated, SKG may propose an adjustment to scope or price before continuing.

6.2 Currency and taxes
Unless expressly stated otherwise, all prices are in Canadian dollars (CAD) and may be subject to applicable taxes (e.g., HST/GST/PST), which will be added where required by law.

6.3 Payment methods
Payment methods accepted (for example, credit card, debit, e-transfer, or other digital payments) will be disclosed on our website or at the time of booking. SKG may require:

  • Payment in advance;

  • A pre-authorization on your payment card; or

  • Payment immediately upon completion of the service.

6.4 Non-payment and late payment
If a payment is declined or not received when due, SKG may:

  • Suspend or cancel future bookings;

  • Charge reasonable late payment or administrative fees where permitted by law;

  • Take lawful steps to recover amounts owing, including using collection services or legal proceedings.

7. Changes On-Site and Additional Work

7.1 Change of scope during visit
If you request additional work not included in the original booking (e.g., extra rooms, add-on services, or extended time), SKG may:

  • Provide a revised estimate verbally or in writing; and

  • Require your approval before commencing the additional work.

7.2 Time-based or flat-rate models
Some services are billed as flat-rate packages, while others may be time-based. SKG will specify which model applies. If the work cannot reasonably be completed within the flat-rate scope due to property condition or misdescribed size, SKG may adjust scope, price, or timing, subject to your agreement.

8. Satisfaction, Defects, and Damage

8.1 Service issues and re-clean window
If you are dissatisfied with the quality of a service, you must notify SKG within a reasonable time window after completion (for example, within 24–48 hours). Where your complaint is justified and attributable to our performance (not pre-existing conditions), SKG may, at its discretion:

  • Return to re-clean the affected area; or

  • Provide a partial credit or other reasonable remedy.

8.2 Pre-existing damage and fragile items
SKG is not responsible for:

  • Wear and tear, pre-existing damage, or defects;

  • Items that are inherently fragile or improperly installed (e.g., unsecured shelves, unstable fixtures);

  • Deterioration of surfaces due to age, poor materials, or previous improper cleaning products.

8.3 Reporting damage
Any alleged damage caused by SKG must be:

  • Reported to us as soon as reasonably possible; and

  • Documented with clear description and, if available, photos.

SKG may inspect the property or request further information before determining an appropriate remedy.

8.4 Limit on remedies for damage
Where SKG is found responsible for damage, our obligation is limited, at our option, to:

  • Repairing the damage;

  • Replacing the item with a comparable item (taking depreciation into account); or

  • Paying the reasonable cost of repair or replacement, subject to any applicable insurance policy and these Terms.

9. Online Accounts, Website Use, and Acceptable Conduct

9.1 Accounts and credentials
If you create an account on our website or platform, you are responsible for:

  • Maintaining the confidentiality of your login credentials;

  • Restricting access to your device(s);

  • All activities that occur under your account.

You must notify SKG promptly if you suspect unauthorized access or misuse of your account.

9.2 Acceptable use
You agree not to:

  • Use our website or systems for unlawful purposes;

  • Attempt to gain unauthorized access to our servers or networks;

  • Interfere with the security or operation of our systems;

  • Scrape, copy, or reverse engineer our website beyond what is allowed by applicable law and normal browser use.

SKG may suspend or terminate access to its website or tools if you breach this clause.

9.3 Intellectual property
All content, design, logos, text, graphics, and other materials on SKG’s websites or marketing materials are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, or create derivative works based on this content without SKG’s prior written consent.

10. Third-Party Services and Links

Our websites or communications may contain links to third-party websites, platforms, or services not operated or controlled by SKG. We are not responsible for:

  • The content, policies, or practices of third-party sites; or

  • Any damages or losses arising from your use of third-party services.

Your use of third-party websites is at your own risk and subject to their terms and privacy policies.

11. Privacy and Data Protection

11.1 Privacy Policy incorporation
Our handling of personal information is governed by our Privacy Policy (Canada), which is incorporated into these Terms by reference.

11.2 Consent to data processing
By using our Services, you acknowledge that we may collect, use, and disclose your personal information in accordance with our Privacy Policy and applicable Canadian privacy laws.

12. Disclaimers

12.1 General disclaimer
To the fullest extent permitted by applicable law, SKG provides the Services on an “as available” basis and disclaims all warranties, conditions, and representations, whether express, implied, statutory, or otherwise, including implied warranties or conditions of merchantability, fitness for a particular purpose, and non-infringement.

12.2 Limitations subject to consumer law
Nothing in these Terms is intended to limit or exclude any rights or remedies that you may have under applicable consumer-protection legislation in Canada that cannot be lawfully limited or excluded.

13. Limitation of Liability

13.1 Indirect and consequential damages
To the fullest extent permitted by law, SKG and LERACH SKG BOCAZZILA INC. are not liable for:

  • Indirect, incidental, special, consequential, or punitive damages;

  • Loss of profits, revenue, business opportunities, goodwill, or data;
    arising out of or in connection with the Services or these Terms, even if we have been advised of the possibility of such damages.

13.2 Aggregate cap
To the fullest extent permitted by law, SKG’s total aggregate liability for any claim arising out of or relating to the Services or these Terms is limited to the total amount paid by you to SKG for the specific Service(s) giving rise to the claim.

13.3 No limitation for certain matters
Nothing in these Terms excludes or limits liability to the extent that such exclusion or limitation is prohibited by applicable Canadian law (for example, liability for gross negligence or intentional misconduct where such limitation is not permitted).

14. Indemnity

You agree to indemnify and hold harmless SKG and LERACH SKG BOCAZZILA INC., and their officers, directors, employees, and agents, from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms;

  • Your misuse of the Services; or

  • Any misrepresentation you make to SKG.

This indemnity is subject to applicable law and does not apply to the extent of SKG’s own negligence or breach.

15. Force Majeure

SKG is not liable for any delay or failure to perform its obligations under these Terms if such delay or failure is due to events beyond its reasonable control, including:

  • Acts of nature (e.g., storms, floods, fires);

  • Public health emergencies;

  • Power outages, network failures, or major system disruptions;

  • Labor disputes or transportation interruptions;

  • Governmental actions or restrictions.

If a force majeure event occurs, SKG may suspend or adjust Services and will act reasonably to minimize disruption where practical.

16. Governing Law and Dispute Resolution

16.1 Governing law
These Terms, and any dispute arising out of or in connection with them, are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles.

16.2 Jurisdiction
Subject to any mandatory rights you may have under consumer laws, you agree that any legal proceeding relating to these Terms or the Services shall be brought exclusively before the courts of the Province of Ontario, sitting in [City, e.g., Toronto], Canada.
